Law and Tradition

The tradition, customs, and beliefs upon which the law of the land of a people is enshrined in the cause of time upon deliberation sometimes experience a paradigm shift and the knowledge of the passed of the law in this situation will be beneficial in making the necessary adjustment to the law.

It is not just what the laws says but the context in which the law says it. Thus, the context of the law, the structure and how the rules are interpreted must be considered and only when that is done can the decide case.

The law is influenced by its context and understanding the context of the law according to Krygier is of utmost importance; it is the precondition of lawyering and this is why he said, “to know and understand the system of law is in so many ways similar to knowing and understanding a language.” Language is complex and just like language so too is the law.

Misused grammar can distort meaning, cause confusions and render what is said useless, and this is the same thing with the law just as the rules of grammar are respected the law needs even more.
